Privacy Policy

AMD Medicom Inc. (“Medicom”, “we” or “us”) has created this Privacy Policy to demonstrate its firm commitment to maintaining the confidentiality and security of your personal information. This Privacy Policy establishes guidelines with respect to our collection, use, disclosure and retention of personal information that you may provide to us. In addition to reading this Privacy Policy, please review our Terms of Use, which governs your use of the Sites (as defined below) and our services. If you do not agree to the collection, use, disclosure and retention of your personal information in accordance with this Privacy Policy, you may not ‎access or otherwise use the Sites. By using the Sites, you accept the terms of this Privacy Policy. We encourage you to read this Privacy Policy in full to understand our privacy practices before using the Sites or submitting any personal information.

1. Scope

This Privacy Policy applies only to the visitors of Medicom websites and social media channels (the “Sites”) who are subject to Canadian, including Québec, privacy laws. Medicom affiliates and subsidiaries outside of North America may have separate websites, subdomains, and applications through other web, mobile, cloud or platforms which are not subject to this Privacy Policy. Additionally, Medicom business partners and other third parties may have their own websites and services with separate privacy practices. We encourage you to read the privacy policies of all websites you visit to understand their privacy practices and your options. In this Privacy Policy, the term “personal information” means information about an identifiable individual or that allows an individual to be identified directly or indirectly. When necessary, we will provide you with additional information relating to the processing of your personal information before collecting your personal information via a distinct consent form for example.

2. Processing of your personal information: what categories of personal Information do we collect, how do we collect it, for what purposes and with whom do we communicate it

You agree to post content on this Site in compliance with these terms and conditions. Upon posting content on this Site, you grant Medicom and its successors and assigns a non-exclusive, worldwide, royalty-free, perpetual right and licence under your copyright to use, adapt, publish, distribute, translate, reproduce and create works derived from or based upon such material in any and all media, without any duty to account to you. In addition, you irrevocably waive all of your moral rights as author in respect of such information, however arising. You shall not post content that includes or contains: (1) non-public information about companies without the proper authorization to do so; (2) false information about yourself or others; or (3) a virus, trojan horse, worm, or other harmful or disruptive component.

2.1. When you visit our websites or social media pages:

We may collect the following categories of Personal information:

  • Unique identifiers and user behavioral information collected passively, such as your IP address, browser type, operating system, internet service provider (ISP), referring/exit pages, data/timestamp, page navigation and clickstream behavior;
  • Personal information you provide when communicating with us, including by using our Sites, third party social media or other web sites, or by subscribing to our email notification service;
  • Personal Information detailed in section 4 of this Policy (tracking technologies).

We may collect your Personal Information directly from you or from our service providers who communicate your Personal Information to us, including via your interactions with our social media pages.

We will process your Personal Information for the following purposes:

  • Provide personalized Sites’ content based on your preferences, including via the use of cookies;
  • Ensure that our Sites run smoothly and to improve the functionality of the Sites to better serve your requirements;
  • Combine information about you from affiliates, subsidiaries, business partners, ad networks, other third parties, and from others to enrich your experience with our products and services;
  • Market products and services.

Companies such as LinkedIn, Meta, Google or Salesforce may have access to certain of your navigation information via the use of third-party cookies when you browse our Sites.

2.2. When you apply to join our team:

We may collect the following categories of Personal information:

  • Contact information, such as your name, home or other physical address, email, telephone number, fax number, date of birth, social insurance number, organization name, job title or any other contact or personal information;
  • If you apply for a position through the “Careers” page of our Sites, we will collect the personal information contained in your application package or generated in relation to your application in order to evaluate your application and assess whether to offer you a position. If you are hired, the information will be retained, used and disclosed in accordance with our Privacy Policy applicable to the personal information of our employees. If you are not offered or do not accept a position, we may retain this information for a reasonable period in the event that an appropriate position becomes available or that you re-apply.

We may collect your Personal Information directly from you or from human resources service providers such as headhunters, background and reference check providers and employment agencies who communicate your Personal Information to us:

We will process your Personal Information for the following purposes:

  • Evaluate any job application you may submit and assess whether to offer you a position and, where you have previously applied for a job, to keep in touch with you about available job positions which we think may be of interest to you;
  • Meet legal, regulatory, legal processes, audit or enforceable governmental requirements.

We may communicate your personal information with human resources service providers who are bound by confidentiality covenants.

2.3. When you communicate with us or require our services:

We may collect the following categories of Personal information:

  • Contact information, such as your name, home or other physical address, email, telephone number, fax number, date of birth, social insurance number, financial information, organization name, job title or any other contact or personal information;
  • Personal information you provide when communicating with us, including by using our Sites, third party social media or other web sites, or by subscribing to our email notification service;
  • If you wish to subscribe to our newsletter(s), we will collect your name and email address.

Companies such as LinkedIn, Meta, Google or Salesforce may have access to certain of your navigation information via the use of third-party cookies when you browse our Sites.

We will process your Personal Information for the following purposes:

  • Provide you with any email notification services you may request;
  • Communicate with you and respond to your inquiries, requests and applications and/or send important information;
  • Send newsletters to you.

You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or contacting us using the contact information listed below in this Privacy Policy.

We may communicate your personal information with service providers who our bound by confidentiality covenants.

3. Communication of your Personal Information

Your personal information can be accessible to our employees, contractors and agents who need to know that information to process it for us, and who are subject to confidentiality obligations.

If you are a person subject to Québec privacy laws, you understand that it is possible that your personal information will be communicated outside of the Province of Quebec when we communicate your personal information to one of our service providers.

Medicom does not sell your personal information to third parties.  We may provide your personal information to third parties that provide services to help us with our business activities such as advertising services and data analytics services. We refer you back to section 2 above for more information of the categories of third parties with whom we may share your personal information. These companies are authorized to use personal information about you only as necessary to provide these services to us. We may provide your personal information to affiliates within the Medicom Group for the purposes of sales, marketing and financial data analysis. We will ensure that all Medicom entities will take due care that all processing of your personal information is in line with this Privacy Policy. Medicom may share anonymized and aggregated data to other organizations that may use such data for improving products and services as well as for the purposes of tailoring the marketing, displaying and selling of those products and services.

Medicom may also need to share information with companies, organizations, or individuals outside of Medicom if we have a good faith belief that access, use, preservation, or disclosure of that information is reasonably necessary to:

  • Meet legal, regulatory, legal processes, audit or enforceable governmental requirements;
  • Enforce applicable Terms of Service, including investigation of potential violations;
  • Detect, prevent, or otherwise address fraud, security, or technical issues;
  • Protect against harm to the rights, property or safety of our users, Medicom, or the public as required or permitted by law;
  • Engage in a financing, merger, acquisition, reorganization, or sale of all or a portion of Medicom assets;
  • To any other third party with your prior consent to do so.

We take reasonable contractual and other measures to require that the organizations with whom we share personal information maintain the confidentiality of such personal information in accordance with applicable laws and only use such information for the specific purpose for which we supply it to them.

4. Identification, Profiling and Tracking Technologies

We use various technologies to collect browsing information about users of the Sites. These technologies include the following:

  • Log Data
    • As is true of most websites, we gather certain information automatically and store it in log files. This information may include IP addresses, browser type, operating system, date/time stamp and/or clickstream data. We do not link this automatically collected data to other information we may collect about you.
  • Cookies, pixels, web beacons and Similar Technologies
    • We may utilize cookies. Cookies uniquely identify your device associated with the Sites and remember your settings. You can control the use of cookies by adjusting your browser preferences at any time. If you reject cookies, you may still use the Sites, but your ability to use some features or areas of the Sites may be limited.
    • We may partner with a third party to manage our advertising on other websites. Our third party partner may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests.
    • We also may use local storage such as HTML5 to store content information and preferences. Third parties with whom we may partner with to provide certain features on the Sites may use local storage such as HTML5 to collect and store information. Various browsers may offer their own management tools for removing local storage.
  • Usage Information
    • We collect information about how you use our Sites, such as the types of content that you view or engage with, the features you use, the actions you take, and the time, frequency and duration of your activities.
  • Geo-location Services
    • When you chose to enable a location-based service, we may collect information about your location. Your browser may use various technologies to determine location, such as sensor data from your device that may provide information on nearby Wi-Fi access points and cell towers. You may opt-out of geo-location collection by changing the setting of your browser or device.
  • “Do Not Track” Signals
    • Some web browsers have a “Do Not Track” feature. This feature allows you to tell websites you visit that you do not want to have your online activity tracked over time and across websites. These features are not yet uniform across browsers. Our Sites does not respond to web browser “Do No Track” signals.

These technologies are used to analyze trends and gather demographic information about our users. We may receive reports based on the use of these technologies by companies such as Google Analytics on an individual as well as aggregated basis.

When these technologies use your personal information to identify, profile or otherwise track you, they will be deactivated by default. Activating these technologies may greatly increase and personalize your experience.

5. Your Rights

Some Medicom products and services allow you to directly access, correct, update, or delete your personal information through your account settings. If this option is not available, contact your account representative or our Privacy Office at privacy@medicom.ca or the address listed below to exercise your rights. We may take steps to verify your identity before honouring these requests. These rights are subject to exceptions.

5.1. Types of rights:

You have several rights with respect to your personal information. Specifically, you have the following rights:

  • Access to your personal information: You may ask us whether we hold any personal information about you and, if so, request access to that personal information.
  • Rectification: You may request to rectify any inaccurate or incomplete personal information we hold about you.
  • Consent withdrawal: You may withdraw your consent to the communication or use of the personal information we hold about you. However, you understand that if you do so, we might be unable to fulfill your order or process any return or exchange for a product you bought. Depending on the extent of your consent withdrawal, we may decide to delete your account.

5.2. How can you exercise your rights?

To exercise any of your rights, please contact our Privacy Officer. Our Privacy Officer will need to confirm your identity before being able to process your request.

5.3. How can you make a complaint about our handling or processing of your personal information?

Medicom takes inquiries, complaints and comments about our handling and processing of your personal information very seriously. We invite you to contact our Privacy Officer if you have any complaints or comments about how we protect your personal information.

Your complaint will be reviewed by our Privacy Officer, who will determine whether our handling of your personal information complies with our privacy program and any applicable laws.

You may also file a complaint with the Commission d’accès à l’information du Québec using the form available on their website. However, we invite you to contact our Privacy Officer first. Our objective is to do our best to resolve your complaint.

If you wish to exercise any rights afforded to you and cannot do so through your account, please send a request to privacy@medicom.ca. If you wish to exercise your right to erasure only as it relates to the use of cookies, you can do this by clearing your cookies in your browser settings.

6. Data Storage, Retention and Security

We do not keep your personal information for longer than necessary for the purposes for which we collect it unless we believe that law or regulation requires us to preserve it. When it is no longer necessary to retain your personal information, we will delete it from our systems, or put it beyond use.

The file containing your personal information will be kept at our offices or those of our service providers and will be accessible to employees, contractors and agents who need to know that information to process it for us, and who are subject to confidentiality obligations.

Medicom has established appropriate physical, electronic and administrative safeguards to protect the information we collect from our users.  We will protect personal information stored on the Sites’ servers from unauthorized access using commercially available computer security products (e.g., firewalls), as well as carefully developed security procedures and practices. Although we use recognized industry safeguards to protect personal information from unauthorized access, loss, misuse and unauthorized alteration and every effort is taken to ensure that no one else will see or obtain your personal data, complete confidentiality and security is not guaranteed over the Internet. Internet use and communication is subject to interception, loss, and alteration. You acknowledge and agree that Medicom shall not be responsible for any damages you may suffer as a result of the transmission of personal information over the Internet, and that any and all communications will be at your own risk.

We will retain your personal information for as long as your account is active or as reasonably useful for commercial purposes. We will retain and use your personal information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

7. Children and Data Collection

Medicom’s Sites are general audience Sites. Medicom’s Sites content is not directed toward children who are under the age of 14. We do not knowingly collect personal information from children or minors. If Medicom becomes aware that a child has provided us with personal information without parental consent, we will endeavor to delete that information from our databases.

8. Content links from Third Parties

The Sites may include seals, buttons, and content links to other companies (for example, Facebook, LinkedIn, X (formerly Twitter), and YouTube). These features may collect your IP address, which page you are visiting on the Sites, and may set a cookie to enable the feature to function properly. When you use a link to go from the Sites to another website, our Privacy Policy is no longer in effect. We encourage you to read the privacy Policy of each website you visit.

9. International Transfers of Personal Information

In some circumstances, the sharing of personal information with third parties or other group companies may involve the storage or processing of personal information outside Canada, including, without limitation, in the United States. We will take reasonable steps to ensure that any international transfer of personal information is carried out in accordance with applicable privacy laws. The protection of such personal information will be subject to the legal requirements of the jurisdictions where the information is transferred, including lawful requirements to disclose information to government authorities in those countries.  At all times, we will utilize appropriate safeguards governing the transfer and usage of your personal information.

10. Changes to this Privacy Policy

This Privacy Policy may be revised from time to time to describe new features, products, or services we offer and how it may affect our use of personal information.  Since we may change this Privacy Policy, we recommend that you check the current version available from time to time.  Your continued provision of personal information or use of our services following any changes to this Policy constitutes your acceptance of any such changes. If we make changes to this Privacy Policy, we will update the “Effective Date” at the beginning of this Privacy Policy.
